Arrested in Rockwall, Heath, Fate or Royse City? The first 15 days after a DWI arrest and the first appearance setting shape everything that follows.
382nd & 439th District Courts (felonies) · County Courts at Law No. 1 & 2 (misdemeanors) · Rockwall Municipal Court
Where a Rockwall County criminal case is heard depends on the level of the charge. Felonies are prosecuted in the 382nd and 439th District Courts. Class A and Class B misdemeanors — including most first-offense DWIs, assault-family violence and theft cases — are heard in County Court at Law No. 1 and No. 2. Class C citations, including most traffic offenses written inside the city, are handled in the Rockwall Municipal Court, and Justice of the Peace courts handle other Class C matters.
Charges can come from the Rockwall Police Department, the Rockwall County Sheriff’s Office, DPS troopers working the Interstate 30 corridor, or the police departments in Heath, Fate, Royse City and Rowlett.

DWI in Rockwall County and the 15-day license deadline
A first-offense DWI in Texas is a Class B misdemeanor under Penal Code § 49.04, carrying a minimum of 72 hours confinement if there is a conviction. If the analyzed alcohol concentration is 0.15 or more, the offense is charged as a Class A misdemeanor under § 49.04(d). A second offense is a Class A misdemeanor; a third is a third-degree felony.
Because Interstate 30 crosses Lake Ray Hubbard on the Eastern Dallas Causeway and runs the length of the county through Rockwall, Fate and Royse City, a large share of Rockwall County DWI stops begin as traffic stops on I-30 or on SH-205, SH-66 and John King Boulevard. The legality of the stop itself is often the first issue worth examining.
Bond, first setting and what to do in week one
- Bail. A Texas magistrate sets bail based on the factors in Code of Criminal Procedure Art. 17.15 — ensuring appearance, the nature of the offense, the ability to make bail, and community safety.
- Conditions. Bond conditions in Rockwall County cases frequently include no-contact orders, alcohol monitoring or an ignition interlock. Violating a condition can revoke the bond even before any conviction.
- Discovery. Under Art. 39.14 (the Michael Morton Act), the State must produce its evidence on timely request — body camera and dash camera video, offense reports and lab results.
- Do not discuss the case. Not on jail calls, not in text messages, not on social media. Jail calls are recorded and routinely used at trial.
Clearing a record: expunction and nondisclosure
Texas offers two distinct forms of relief, and they are not interchangeable. Expunction (Chapter 55A of the Code of Criminal Procedure, formerly Chapter 55) destroys the records of an arrest and is available after an acquittal, a dismissal in qualifying circumstances, or certain Class C deferred dispositions. Nondisclosure (Government Code Chapter 411, Subchapter E-1) seals a record from public view while leaving it available to law enforcement and certain licensing agencies, and is the usual remedy after successfully completing deferred adjudication community supervision.
Both are filed as separate civil-style proceedings, and neither happens automatically when a case ends. Also see our Criminal Law FAQ.

Rockwall criminal defense questions, answered
You are booked, a magistrate advises you of the charges and sets bail, and the case is assigned to a Rockwall County court based on the offense level. Felonies go to the 382nd or 439th District Court; Class A and B misdemeanors go to a County Court at Law. Your first setting is typically a few weeks later.
Between the arrest and that first setting, the most valuable work happens quietly: requesting body-camera and dash-camera video before it is overwritten, identifying witnesses while memories are fresh, and negotiating bond conditions you can actually live with.
Texas has an implied-consent law, and refusing a breath or blood test after a lawful DWI arrest triggers an automatic driver’s-license suspension—180 days for a first refusal. Officers can also seek a warrant for a blood draw, so refusal does not necessarily prevent testing.
Whatever happened at the roadside, the 15-day deadline to request an Administrative License Revocation hearing applies. That single filing is often the difference between keeping and losing your license during the case.
This page describes how the law works generally; it is not advice about your specific stop.
Sometimes. Deferred-adjudication community supervision followed by an order of nondisclosure can seal many Texas misdemeanors from public background checks, and a dismissal or acquittal can support an expunction. Neither is automatic—each requires a separate petition.
Eligibility depends on the offense, your record, and waiting periods that vary by charge. Assault-family violence and DWI cases have their own rules, and some offenses are permanently ineligible.
Not always, but paying a Class C citation is a conviction that goes on your driving or criminal record. Many Rockwall Municipal Court citations can be resolved through deferred disposition or a driving-safety course, which keeps the conviction off your record if completed successfully.
Rockwall Municipal Court handles city-ordinance violations and traffic citations issued inside the city limits. Confirm your court and setting on the citation itself, since Justice of the Peace courts handle Class C matters filed outside city limits.
